TERMS OF MEMBERSHIP AGREEMENT / LIABILITY WAIVER
This Agreement, executed on the date shown on the Student Registration form, by and between Impact Jiu Jitsu Sherwood, hereinafter referred to as Impact Sherwood.
Enrollee(s) certifies that he/she is in good health.
Uniforms, seminars, tournaments, promotions/belts, etc., are separate fees not included in the terms of this agreement.
This agreement comprises entire agreement pertaining to membership. No other agreement of any kind will be recognized by Impact Sherwood.
Consumer’s right of cancellation: You may cancel this agreement penalty free within three (3) days of execution date of this agreement, exclusive of holidays and weekends upon mailing or delivering written certified notice of cancellation to address listed below. This agreement may be canceled for reasons of death or substantial disability by providing a death certificate or disability statement by a certified physician. You may cancel this agreement if the academy goes out of business and fails to provide facilities within five (5) miles of or moves the facilities more than five (5) miles from, the present facilities.
Impact Sherwood agrees to provide instruction in Martial Arts to the enrollee during the scheduled instruction hours of Impact Sherwood. Enrollee understands that it is his or her responsibility to attend instruction sessions. Enrollee understands that the entire course fee stated on the Student Registration is due and payable according to the terms of this agreement whether Enrollee chooses to attend instructional sessions provided by Impact Sherwood or not. In consideration for Impact Sherwood’s promises to instruct and provide instruction facilities, Enrollee agrees and promises to pay the course fees shown on front.
Enrollee agrees to abide by the rules and regulations governing the conduct and operation of instruction sessions, students, and observers, in order to promote efficiency, safety, and recognition of the instruction certification, as prescribed by Impact Sherwood. Enrollee acknowledges that rules and regulations governing Impact Sherwood have been adopted, and may be changed from time to time, and Enrollee agrees to abide by all such rules and regulations as adopted or hereinafter amended. The hours of operations may be changed at the discretion of Impact Sherwood. Impact Sherwood reserves the right to revoke or terminate any membership.
Enrollee agrees that all exercises and/or courses are undertaken at Enrollee’s own risk. The Enrollee understands the procedures and exercises involved in instruction and participation as explained by him/her by an assistant of Impact Sherwood. The Enrollee understands that there is a risk of personal injury involved during the course of instruction and with this knowledge agrees to indemnify and hold harmless Impact Sherwood from all losses caused by accident or injury to the Enrollee, or to third persons, who may be with Enrollee of Impact Sherwood, in the event that either the Enrollee of said third person is injured in any way during the performance and execution of exercises.
Impact Sherwood and its agents and employees shall not be held responsible for damaged, lost or stolen articles, inside or outside the gym. This includes, but not limited to, eyeglasses worn by student during class.
Impact Sherwood reserves the right to amend or add to these rules and conditions and to adopt new rules and conditions, as it may deem necessary.
If an Enrollee terminates payment of agreement without proper notification (7 days), they are responsible for the current month-to-month rate agreed upon.
I, the Enrollee (or parent/guardian of enrollee), irrevocably authorize Impact Sherwood, its successors and assignees, and those acting under its authority, to copy, use, or publish for art, advertising, trade, or any other lawful purpose whatsoever, photographic portraits, pictures, digital images, and/or videos of me, in which I may be included in whole or in part.
In consideration of the training obtained, I agree that I will not, during the continuance of this agreement, engage in teaching Martial Arts or offering similar training or instruction within a fifty (50) mile radius of any school operated by Impact Sherwood without the express written authorization of same.
Should you (the Enrollee) choose to pay for more than one (1) month of this agreement in advance, be aware that you are paying for future services and may be risking loss of your money in the event Impact Sherwood and/or this business location ceases to operate. Impact Sherwood is not required to provide any security, and there may not be other protection provided to you should you choose to pay in advance. *Punch card purchases are NON-REFUNDABLE.
MEMBERSHIP PAYMENT HOLD POLICY
Family issues, employment and medical problems can occasionally interfere with attendance. You (the Enrollee) may “freeze” a membership for up to 3 months over a 12-month period. The account must be current at time of request. A freeze begins on the first (1st) of the month and ends on the date agreed upon on the Membership Freeze Form.
You (the Enrollee) must notify Impact Sherwood at least seven (7) days prior to the next billing cycle and complete/sign a Membership Freeze Form before the freeze will become effective.
Upon your (the Enrollee) membership reinstatement, regular monthly charges will resume.
Impact Sherwood provides special exceptions for pregnancy, incurred injuries, extended illness, or recent unemployment. In such cases, the freeze is open ended (not limited to 90 days.)
